Welcome to KasBack. These Terms of Use (“Terms”) govern your access to and use of the KasBack website, mobile application, services, content, and features (collectively, the “Platform”).
By accessing or using KasBack, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. About KasBack
KasBack is a rewards and promotional platform that helps users discover participating brands, offers, promotions, and cashback opportunities. KasBack may receive commissions, referral fees, advertising fees, or similar compensation from merchants, affiliate networks, or partners when users interact with offers or make qualifying purchases.
KasBack is not a bank, financial institution, payment processor, money remittance service, or digital wallet provider unless explicitly stated otherwise. Any cashback, rewards, or incentives made available through the Platform are promotional in nature and are subject to eligibility, validation, partner confirmation, and these Terms.
2. Eligibility
To use KasBack, you must:
- be at least 18 years old, or the age of legal majority in your jurisdiction;
- have the legal capacity to enter into a binding agreement; and
- comply with all applicable laws and regulations.
By using the Platform, you represent and warrant that you meet these requirements.
3. User Account
You may need to create an account to access certain features of the Platform. You agree to:
- provide accurate, current, and complete information;
- keep your login credentials secure and confidential;
- promptly update any changes to your account information; and
- be responsible for all activities that occur under your account.
KasBack may suspend or terminate accounts that contain false information, are used fraudulently, or violate these Terms.
4. How KasBack Works
KasBack connects users with promotions, affiliate offers, discounts, and cashback opportunities from participating merchants and partners. Cashback or rewards may become available only when:
- the relevant merchant or partner successfully tracks the transaction;
- the purchase is determined to be valid and eligible;
- the transaction is not cancelled, returned, refunded, disputed, or flagged as fraudulent; and
- KasBack receives confirmation or commission from the relevant merchant, network, or partner.
KasBack does not guarantee that every click, visit, or purchase will track successfully or qualify for cashback or rewards.
5. Cashback and Rewards
Cashback, rewards, or similar incentives displayed on the Platform are estimates or promotional offers unless otherwise stated. Eligibility is subject to the merchant’s terms, affiliate network rules, promotional exclusions, and KasBack’s verification process.
KasBack may decline, reverse, adjust, or cancel cashback or rewards where:
- the transaction was not tracked properly;
- the merchant rejects or invalidates the transaction;
- the order is refunded, returned, cancelled, exchanged, or partially reversed;
- duplicate, abusive, suspicious, or fraudulent activity is detected;
- there is a technical error, pricing error, or publishing mistake; or
- the transaction otherwise does not meet the qualifying conditions.
Cashback or rewards are not earned until they are confirmed by the relevant merchant or partner and marked as approved by KasBack.
6. Withdrawals and Payouts
Where withdrawal or payout functionality is available, cashback or rewards may only be withdrawn once they are approved, available for withdrawal, and meet any minimum threshold shown on the Platform.
KasBack may offer one or more payout methods, such as bank transfer, digital wallet, or other third-party payment channels. Payout availability may vary by country, partner, and technical availability.
By requesting a withdrawal, you acknowledge and agree that:
- KasBack may need to verify your identity or account details;
- payout processing times may vary;
- third-party payment providers may apply their own terms, fees, or delays; and
- KasBack may withhold, delay, reject, or cancel a payout where fraud, error, compliance concerns, or account issues are suspected.
KasBack is not responsible for delays or failures caused by third-party payment providers, incorrect payout details submitted by you, banking issues, or factors outside KasBack’s reasonable control.
7. Promotional Nature of Rewards
Cashback, rewards, bonuses, referral incentives, and similar benefits offered by KasBack are promotional benefits and do not constitute deposits, stored monetary value, investment products, interest-bearing accounts, or financial products unless expressly stated otherwise.
Users do not acquire ownership rights over unconfirmed cashback or pending rewards. Pending amounts remain conditional until approved according to these Terms.
8. Merchant Offers and Third-Party Services
KasBack may display offers, links, advertisements, promotions, or services provided by third parties, including merchants, affiliate networks, payment providers, and technology partners.
KasBack does not control and is not responsible for:
- the quality, safety, legality, availability, pricing, delivery, or accuracy of products or services offered by third parties;
- merchant websites, policies, or promotional terms;
- failed tracking caused by ad blockers, browser settings, device settings, or third-party systems; or
- disputes relating to purchases, returns, refunds, delivery, warranties, or customer service provided by merchants.
Your transactions with merchants or third parties are solely between you and the relevant party.
9. User Conduct
You agree not to:
- use the Platform for unlawful, misleading, fraudulent, or abusive purposes;
- create multiple accounts for improper gain;
- manipulate tracking, referrals, clicks, or transactions;
- exploit bugs, errors, or loopholes in the Platform;
- impersonate any person or entity;
- interfere with the operation, security, or integrity of the Platform; or
- copy, scrape, reverse engineer, or misuse the Platform or its content without authorization.
KasBack may investigate suspected misuse and take action including suspension, cancellation of rewards, account termination, and legal action where appropriate.
10. Referrals and Promotions
KasBack may offer referral programs, welcome bonuses, promotional campaigns, or limited-time incentives. Such programs may be governed by additional rules, campaign terms, or eligibility conditions published on the Platform.
KasBack reserves the right to modify, suspend, reject, or cancel referral or promotional rewards where abuse, duplicate accounts, self-referrals, fraudulent activity, or breaches of these Terms are detected.
11. Intellectual Property
All content, branding, logos, graphics, text, software, features, and materials on the Platform, excluding third-party trademarks and content, are owned by or licensed to KasBack and are protected by applicable intellectual property laws.
You may not reproduce, modify, distribute, sell, publish, or exploit any part of the Platform without KasBack’s prior written consent.
12. Privacy
Your use of the Platform is also subject to the KasBack Privacy Policy. By using the Platform, you acknowledge that KasBack may collect, use, and disclose your information in accordance with its Privacy Policy.
13. Account Suspension and Termination
KasBack may suspend, restrict, or terminate your access to the Platform at any time, with or without notice, if:
- you breach these Terms;
- KasBack suspects fraud, abuse, or unlawful conduct;
- required by law, regulation, court order, or partner requirements; or
- continued access would create risk or liability for KasBack, its users, or its partners.
Upon suspension or termination, KasBack may cancel pending or unapproved cashback or rewards to the extent permitted by law.
14. Disclaimers
The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, KasBack makes no warranties, representations, or guarantees of any kind, whether express or implied, including regarding:
- uninterrupted or error-free access;
- successful transaction tracking;
- merchant participation or availability;
- accuracy of cashback estimates, offer details, or promotional content; or
- fitness for a particular purpose.
KasBack does not warrant that the Platform will always be secure, available, or free from errors, viruses, or other harmful components.
15. Limitation of Liability
To the fullest extent permitted by law, KasBack and its directors, officers, employees, affiliates, partners, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, opportunities, or business arising out of or related to your use of the Platform.
To the extent permitted by law, KasBack’s total liability for any claim arising out of or relating to the Platform or these Terms will not exceed the total amount of approved cashback or rewards paid to you by KasBack in the 12 months preceding the event giving rise to the claim, or AUD $100, whichever is greater.
Nothing in these Terms excludes rights or remedies that cannot be excluded under applicable law.
16. Indemnity
You agree to indemnify and hold harmless KasBack and its affiliates, officers, employees, partners, and service providers from and against any claims, losses, liabilities, damages, costs, or expenses arising out of:
- your misuse of the Platform;
- your breach of these Terms;
- your violation of any law or third-party rights; or
- any fraudulent, misleading, or unlawful activity conducted through your account.
17. Changes to the Platform or Terms
KasBack may update, modify, suspend, or discontinue any part of the Platform at any time.
KasBack may also amend these Terms from time to time. Updated Terms will be posted on the Platform with the revised effective date. Your continued use of the Platform after the updated Terms take effect constitutes your acceptance of the revised Terms.
18. Governing Law
These Terms are governed by the laws of [Insert Jurisdiction], without regard to conflict of law principles.
Any disputes arising out of or in connection with these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of [Insert Jurisdiction], unless otherwise required by applicable law.
